Who we are
Immetzian is a software and systems engineering business based in Sydney, Australia. It is a trading name of Scalemotive LLC, a Wyoming limited liability company. In this notice, "we" and "us" mean Scalemotive LLC.
This notice explains how we handle personal information collected through this website. Scalemotive LLC is responsible for that information under the Australian Privacy Act 1988 (Cth) and the Australian Privacy Principles. Where the GDPR or the UK GDPR applies, Scalemotive LLC is the controller of it.
What we collect
What you give us. When you send a project brief we receive what you type into the form: your name, email address, company if you give one, the kind of work you need, your timeline and budget if you give them, and your message. If you email us, we receive your message and your email address.
What the site records. Our hosting provider keeps short-lived server logs of each request, such as IP address, browser and the page requested. When you send a brief, our server also holds your IP address in memory for up to an hour, to limit how often the form can be sent.
Visit counts. We count visits with Vercel Web Analytics, which reports pages viewed and general details such as country and device type. It works without cookies and does not identify you.
We do not ask for sensitive information, such as health or financial details, and ask that you leave it out of your brief.
Cookies
This site does not set cookies or store anything in your browser. It uses no advertising or cross-site tracking tools.
How we use it, and why
We use what you send to reply to you, to discuss the work you asked about and, if we go ahead, to prepare a proposal. That is the purpose we collect it for, and we do not use it for any other purpose without your consent unless the law allows it.
We use server logs and the form limit to keep the site running and to stop abuse, and visit counts to understand which pages people read.
Where the GDPR or the UK GDPR applies, we rely on two legal bases: taking steps you ask for before a possible contract (replying to your brief), and our legitimate interest in keeping the site secure and understanding how it is used.
We do not sell your personal information, share it for advertising, add you to mailing lists or make automated decisions about you.
Who we share it with
We use two service providers, who handle information only on our behalf and under their own security and data protection terms: Vercel, which hosts the site and counts visits, and Resend, which delivers each brief to our mailbox.
We may also disclose information if the law requires it, or to protect our rights in a legal claim. We do not share it with anyone else.
Information held outside Australia
Vercel and Resend are based in the United States, so your information may be stored or processed there and in other countries where they operate. We take reasonable steps to make sure they handle it in a way consistent with the Australian Privacy Principles.
Where the GDPR or the UK GDPR applies, we rely on the safeguards these providers offer for international transfers, such as standard contractual clauses.
How long we keep it
Briefs that do not lead to work are deleted after 24 months. If we work together, project correspondence is kept for as long as the law requires, for example for tax records. Server logs and visit counts are kept by Vercel for its standard periods. Addresses held for the form limit are cleared within an hour.
How we protect it
The site is served only over encrypted connections. Briefs reach us by email and are read only by the people who reply to them. We take reasonable steps to protect personal information from misuse, loss and unauthorised access, change or disclosure.
Your rights
You can ask to see the personal information we hold about you and ask us to correct it. You can also ask us to delete it.
If you are in the European Union or the United Kingdom, you also have the right to restrict or object to how we use your information, to receive a copy in a portable form, and to withdraw consent where we rely on it.
If you are in California or another US state with a privacy law, you have the right to know what we collect, to have it corrected or deleted, and to opt out of its sale or sharing for advertising. We do neither. We will not treat you differently for using these rights.
To make a request, send a brief through this site or email us. We may need to confirm who you are, and we reply within 30 days.
Complaints
If you think we have mishandled your information, contact us first and we will look into it and reply within 30 days. If you are not satisfied with our answer, you can complain to the Office of the Australian Information Commissioner (oaic.gov.au). In the European Union you can complain to your local data protection authority, and in the United Kingdom to the Information Commissioner's Office (ico.org.uk).
Children
This site is for businesses. It is not directed at children, and we do not knowingly collect information from anyone under 16.
